Terms of Usage Agreement

By submitting a picture to WTOC through this site, you agree to the the terms below and electronically sign the Terns of Usage Agreement. If you do not agree to these terms, then do not submit your picture.

Terms of Usage Agreement:

Ownership. You warrant and represent that you own or otherwise control all of the intellectual property rights in the picture and that use of the picture by WTOC will not infringe or violate any intellectual property rights of any third party.

License. You grant WTOC a world-wide, royalty free, perpetual, irrevocable and non-exclusive license to use, reproduce, modify, adapt, publish, distribute and/or display the picture anywhere, for any purpose, and in any form, media or technology now known or later developed. No compensation will be paid with respect to the use of your picture. WTOC is under no obligation to use or post any pictures you provide and may remove any posting at any time.

Limitation of Liability. In no event shall WTOC or its affiliated stations be liable to you in any manner whatsoever for any direct, incidental, consequential, special or exemplary damages arising out of the use of the picture . These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability and/or any other basis.

Indemnification. Upon a request by WTOC, you agree to defend, indemnify and hold harmless WTOC and its parent companies, subsidiaries, affiliates, officers, agents, co-branders and employees from all liabilities, claims and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of the photographs you submit, post to or transmit through this site.

Disclaimers. This site is provided "AS IS" without any warranty, express or implied, including, without limitation, any warranty as the accuracy, reliability, or completeness of any information contained on or received through this site.
