Bobby Buckner's attorney pleased with judge's decision
SAVANNAH, GA (WTOC) -
Bobby Buckner's attorney is pleased with a judges decision to throw out the killing and kidnapping case of Ashleigh Moore, 12.
Attorney Newell Hamilton says the District Attorney was difficult to deal with and unorganized. Hamilton says the case was dragged along for too long.
Buckner was arrested for kidnapping and strangling Ashleigh Moore in 2003. Nearly a decade later, he still hadn't gone on trial.
The judge ruled on Wednesday that the multiple delays were a violation of his sixth amendment rights to a speedy trial and called out the District Attorney's office for being unprepared.
Buckner's attorney totally agrees.
"We had to fight tooth and nail for documents we thought we were entitled to and that the DA should have provided earlier, but didn't. We certainly were disappointed when the state decided to ask to take a man's life and didn't have their ducks in a row to move forward. They weren't prepared," Hamilton said.
Buckner remains in jail on previous charges.
The District Attorney has a month to appeal the judge's decision.
