Victim's brother on the stand for day 2 of Gale murder trial

DARIEN, GA (WTOC) -

The prosecution continued to try and portray Brian Gale as uncaring and cruel on day two of his murder trial.

Gale is on trial after his stepson Daniel Gale was found dead in the Buffalo Swamp in March of 2010.

On Monday, Gale's ex wife Susan Bennett testified that Brian Gale was not especially distraught after the death and told her to "get over it."

Tuesday, Daniel's brother Christopher took the stand. He told the jury about a conversation he had with Brian Gale after Daniel's body was found.

"I asked him where is my brother at? He said it was either one of us or both of us," Christopher Head said.

The prosecution has said throughout the trial that Gale knew the Buffalo Swamp like the back of his hand.

They say it doesn't make sense that Gale got lost and that his GPS suddenly stopped working. The prosecution also pointed out that Gale has changed his story over and over again.

The defense says this was a terrible death, but that nothing criminal is involved. They say Brian Gale loved Daniel like a son.

Gale's defense attorney Carlton Gibson told the jury Daniel was on Xanax when he went hunting in the woods. Gibson says the boy could not walk any longer

because of the medication.

The trial will continue on Wednesday. The prosecution is expected to call three more witnesses and then the defense will begin.
