Ga. high court to consider murder charge dismissal

ATLANTA (AP) - The Chatham County district attorney has appealed a judge's dismissal of kidnapping and murder charges in the 2003 slaying of a 12-year-old girl.

The Georgia Supreme Court will hear arguments in the case Monday.

Bobby Lavon Buckner was charged in the 2007 slaying of Ashleigh Moore, his girlfriend's daughter.

A trial court judge in May dismissed the charges against Buckner, saying prosecutors had violated his right to a speedy trial. The judge cited constant delays and allegations that evidence had been lost.

The state argues that the delay period in the case begins with Buckner's first indictment in 2007 and that 53 months of delay is not uncommonly long. The state also contends allegations that evidence was deliberately withheld to harm the defense are baseless.
