EFFINGHAM CO., GA (WTOC) -

The Effingham County Sheriff's Office is charging three people in connection with an incident where a 13-year-old boy was shot after he and his 14-year-old cousin went into someone else's house on May 23.

Deputies responded to a residence on Go Cart Rd. shortly before 8 p.m. on the report of a burglary in progress and a person shot. The investigation has revealed that the two teens had entered someone's property on Go Cart Rd. without the consent of the owner. According to police, the property owner, Irvin Helmey, 73, of Guyton, approached the property with a firearm and demanded that the teens surrender. The 13-year-old boy came out of the house and fled across the street when a shot was fired and he was struck.

The child suffered non life threatening injuries. His 14-year-old cousin remained inside and was not harmed.

After a thorough investigation, charges have been warranted for the teenagers for criminal trespass and for Helmey, who has been arrested for aggravated assault.

According to Effingham County Sheriff's Office, the case will be presented to a grand jury.
