HINESVILLE, GA (WTOC) -

The shooting death of a burglary victim brought murder charges against the hospitalized suspect. Hinesville police confirmed Monday that Jeremias Ortiz died late Sunday. By Monday afternoon, detectives had secured warrants that included charges of malice murder and felony murder against Kyle Perry.

Detectives believe Perry broke into Ortiz's condominium in Colonial Parks early Sunday morning. Ortiz and his wife heard noise and Ortiz went downstairs. Police say Ortiz and the robber began shooting and wounded each other. The intruder fled. Ortiz was rushed to the hospital. Perry later showed up at the emergency room with a gunshot wound.

According to Hinesville Police Major Thomas Cribbs, Perry was hospitalized under guard. He was previously charged with burglary, aggravated assault, and possession of marijuana. According to the Liberty County Sheriff's Office, Perry has been booked there on various charges nine times since 2009.

Perry was released from the hospital on Tuesday and transported to the Liberty County Jail.
