Court of Appeals upholds Georgia-Pacific class action lawsuit

EFFINGHAM CO., GA (WTOC) -

The state's Court of Appeals has upheld a lower court ruling granting class action status to a lawsuit filed against the Georgia-Pacific Corporation by a group of Effingham County residents. 

Originally, four homeowners sued Georgia-Pacific for nuisance, trespass and negligence involving the company's Savannah River Mill plant in Rincon, claiming the mill's continued release of hydrogen-sulfide gas had caused damage to their property. 

A trial court certified the class action which includes 65 additional property owners. 

Georgia-Pacific argued that the trial court abused its discretion but the appeals court disagreed.
