A judge denied a bond modification for a tow truck driver charged in a fatal shooting that occurred on Dec. 24, 2010.

Preston Oates is accused of fatally shooting Carlos Olivera after trying to tow his car in the Edgefield subdivision.

It has taken nearly three years for this case to move forward. Oates has raised the state's Castle Doctrine, similar to the stand-your-ground law, which would give Oates immunity from prosecution. 

Oates has claimed self defense, saying Olivera flashed a gun at him while he was trying to put a boot on his van. 

Video of the shooting was caught on a neighbor's surveillance camera.

At Wednesday's bond hearing, the judge ordered Oates to stay in his ankle monitor.
