Earnest Daise is on trial for his life.

Daise is accused of killing his girlfriend, 32-year-old Jeanine Mullen and her four year old son back in November 2009 on Player Road in Dale, South Carolina.

Testimony wrapped up late Monday for the first day of the trial.

Earnest Daise faces two counts of murder and one count of assault and battery with intent to kill, trafficking crack cocaine and possession of marijuana with intent to distribute.

He pleaded not guilty to the charges.

During opening statements, Prosecutor Duffie Stone said Daise's three and a half year relationship with his girlfriend, Jeanine Mullen, ended on November 15th, 2009 when he killed her and her son inside her home in Dale, South Carolina.

Investigators found the boy's body in the kitchen and the mother in the back bedroom.

Both suffered gunshot wounds to the head.

Daise also allegedly shot their two and a half year old son, Jeremiah, but he survived.

"Jeremiah at two and half years old was shot, he was shot in the head just like his four year old brother and just like his mother. But by the grace of God, Jeremiah lived, the bullet went into his ear, hit the back of his spinal column and tumbled through his chest," said Duffie Stone, Solicitor for the 14th Judicial Circuit.

No motive has been presented for the case yet.

Earnest Daise will face the death penalty if a jury finds him guilty.

The case is expected to last two weeks and testimony will resume Tuesday at 9:30am.
