Court upholds SCAD murder convictions, orders resentencing

SAVANNAH, GA (WTOC) -

New developments have surfaced in the case of two men accused of killing a SCAD student in 2010.

Alex Cowart and John Adams were convicted of murder in the death of Sean Giroir.

The Supreme Court of Georgia has now upheld Cowart's conviction, but is sending the case back to the lower court for resentencing because he was improperly sentenced for two felony murder convictions when there was a single victim.

The court has also reversed the convictions of Cowart's co-defendant, John A. Adams, ruling he is entitled to a new trial due to the erroneous and harmful admission of certain evidence. However, the court states the evidence presented at trial was sufficient to authorize a rational jury to find Adams guilty beyond a reasonable doubt.
