Alabama man indicted in Ft. Stewart soldier's slaying

A federal grand jury in Savannah has indicted an Alabama man on charges of first-degree murder in the death of a Fort Stewart soldier.

Carl Evan Swain, 43, was indicted in connection with the Nov. 30 beating death of 29-year-old Spc. John Joseph Beans Eubank, according to the U.S. Attorney's Office for the Southern District of Georgia, Savannah Office.

The FBI is investigating the case. A death that occurs within the special maritime and territorial jurisdiction of the U.S. is a federal crime. 

United States Attorney Ed Tarver stressed that an indictment is only an accusation and is not evidence of guilt.  The defendant is entitled to a fair trial, during which it will be the government's burden to prove guilt beyond a reasonable doubt.
