St. Joseph's/Candler asks judge to drop lawsuit

SAVANNAH, GA (WTOC) -

St. Joseph's/Candler is respondingto a lawsuit filed by an employee who was kidnapped from the hospital campusand sexually assaulted elsewhere in Savannah.

WTOC just received the paperwork Fridayafternoon. The hospital is asking a judge to dismiss the lawsuit.

The hospital cited a Georgia law,which says a landowner only has a duty to protect against the foreseeable criminalacts of third parties and the hospital says this act was not foreseeable.

The hospital also said in thestatement that there's nothing they could have done to prevent the suspect fromcoming onto their property and carjacking the victim.

WTOC reached out to the victim'sattorney Mark Tate. He said that now he will begin collecting depositions.

The suspect is still on the loose.
