Dinwiddie mother will plead guilty in newborn's death

A Dinwiddie mother plans to plead guilty in the death of her newborn, who was found in a toilet last year, her attorney said in court Tuesday.

A judge certified the case against Devin Monique Small to Circuit Court Tuesday. Her attorney, Joe Morrissey, said in court he met with prosecutors this week and worked out a deal for Small to plead guilty to involuntary manslaughter when her case is heard in April. She was originally charged with first-degree murder in the September death of her newborn.

Morrissey said Small left church, unaware she was going to give birth, went to the restroom at a home in the Sutherland area and gave birth to the child in a toilet.

Sheriff deputies were called to the home in the 18000 block of Namozine Road and found the baby dead, still in the toilet.

Small was charged with murder after an autopsy by the medical examiners. Small's mother, Angela Small, was also charged with first-degree murder. However she has since passed away.

Devin Small is due back in court on April 15. She is currently being held on $30,000 bond.
