SAVANNAH, GA (WTOC) -

A 70-year-old tour boat captain has filed a lawsuit against Country Music singer Billy Currington in connection with an April 15, 2013 incident. The lawsuit filed in state court alleges elder abuse, libel and seeks damages.

Charles Harvey Ferrelle III filed the lawsuit after he was conducted chartered tour with two passengers that began at A.J.'s Dockside Restaurant and went down the Tybee Back River past Currington's home. Currington is accused of making obscene gestures and yelling obscenities and threats at them. The lawsuit filing alleges Currington pulled his boat alongside Ferrelle's and threatened him with physical harm.

The lawsuit accuses Currington of posting on his official fan website referencing the incident and "mocking, deriding and libeling" him.

Currington had pleaded no contest to the charges in September and was sentenced to five years of probation and a $1,000 fine. He was ordered to undergo anger management counseling and have no contact with the boat captain. In exchange, prosecutors agreed to drop a charge of making terroristic threats.
