(CNN) - Lawyers for Donald Sterling want a probate court trial over the sale of the Los Angeles Clippers moved to federal court.

The trial is scheduled to begin Monday.

Donald Sterling's estranged wife, Shelly Sterling, is asking a judge to approve an agreement she reached with billionaire Steve Ballmer to sell the NBA team.

For years, she and her husband had equal shares in the franchise, but Shelly Sterling negotiated a deal in late May to sell the team after two doctors declared her husband mentally incapacitated.

In April the 80-year old was banned from the NBA for life and fined $2.5 million after private recordings of him making racist comments were made public.

The NBA’s Board of Governors is scheduled to meet July 15 and could approve the sale of the team - if the legal aspects are sorted out.
