Court resumes Wednesday in the malicious prosecution suit against the Beaufort County Sheriff's Office.
Theophilius Hamilton is expected to take the stand Wednesday. He is suing the sheriff's office for the way they handled the investigation into the 2008 brutal beating of Brian Lanese of Bluffton.
Hamilton, Kuwan Fields and Chris Battle were all arrested and charged with the crime.
Hamilton and Battle were both acquitted due to lack of evidence. Battle also sued the sheriff's office but he settled out of court for $30,000.
Fields did not sue and pleaded guilty.
Hamilton is the only one who took the case to trial. They are asking for more than $100,000.
