City of Savannah asks judge to throw out firefighters' lawsuit

SAVANNAH, GA (WTOC) -

The city of Savannah has asked a judge to dismiss a lawsuit brought by more than 50 captains in the Savannah Fire Dept.

The fire captains are claiming they aren't being paid in line with city policies and that they are being paid las much as $20,000 less than newly promoted supervisors in the same position.

"The bargain that these fireman made with the city of Savannah is we're going to go out there every day," said Jeremy McKenzie, attorney for the firefighters. "We're going to defend the citizens, to protect the citizens of Savannah. But you have to pay us what the policy manual says you'll pay us."

The city said the statue of limitations is up on these firefighters' cases and that a judge should dismiss the case because the policy manual is not a contract.
