ATLANTA, GA (WTOC) - The Georgia Supreme Court has denied Troy Anthony Davis' request for a new trial in a 4-to-3 decision this morning.

The Georgia Supreme Court found that Chatham County's superior court did not make a mistake in refusing to grant Davis a new trial without first hearing evidence from Davis' lawyers, which they said was new and could prove his innocence.

Davis was convicted of murdering Savannah police officer Mark MacPhail in 1989. He was granted a temporary stay of execution in July, less than a day before he was scheduled to die.

In August, the Georgia Supreme Court voted to hear an appeal for a new trial.
