SAVANNAH, GA (WTOC) - Still no formal charges for the man police say committed the worst shooting in U. S. History during a midnight showing of "The Dark Knight Rises".

James Holmes, 24, appeared in court Monday morning with his hair dyed orange. Holmes did not speak during the arraignment, closing his eyes at times.

Rachael Bell of Herrin, Bell, & Associates Mental Health in Richmond Hill describes what she calls "unusual behavior".

Bell said, "He was not making eye contact, closing his eyes. He didn't appear as if someone who really had empathy for what he had done."

Bell believes there is definitely something wrong with Holmes, but she says there are still a lot of unknowns about the former graduate student.

"We really don't know the cause so we have to ask the right questions to get the right answers," Bell said. "It didn't help him probably in the courtroom, unless he was going to try and go for the insanity plea. And that might have helped his case. Whether he truly is or not is anyone's guess at this moment,"

Prosecutors say they are considering the death penalty.

Holmes is expected to be formally charged on July 30.
