State says it has not withheld evidence in Murdaugh case

CHARLESTON, S.C. (WCSC) — The State is firing back against Alex Murdaugh’s attorneys and calling their most recent claims completely false.

Lead Prosecutor Creighton Waters is not amused by the slew of defense filings that have essentially accused the State of withholding evidence.

One of the things Murdaugh’s team asked the State to turn over is cell phone data from the night of the murders.

In the filing on Tuesday, Waters says they already turned over all of the cellphone records they had back during the first trial in 2022.

In fact, Waters says they provided the defense with the cellphone data three times before the trial, adding, quote, “The defense has every byte the State possesses.”

He also accuses the defense team of making false statements about things that never happened.

Waters says, quote, “It is hard to understand the inexplicably brazen and highly prejudicial falsehoods the defense puts in its public filings.”

Waters is asking the judge to deny the defense’s motion for additional cellphone data—again—because they say they’ve already shared it.
